The Kind🌿Root Space – Communities Terms & Conditions

These Terms & Conditions (“Agreement”) set out the rights and responsibilities of communities who join The Kind🌿Root Space (“we”, “our”, “us”) to welcome members through our platform. By submitting your community onboarding form and ticking the consent box, you confirm your acceptance of these Terms.

1. Who We Are

The Kind🌿Root Space is a platform connecting individuals and communities with independent wellness practitioners (“you”, “your”). We provide visibility, marketing, client connections, booking tools, and payment processing. We do not employ practitioners or deliver sessions ourselves.

2. What You Receive

As a community with The Kind🌿Root Space, you will receive:
A professional profile on our website, highlighting your offering, approach, and schedule.
Visibility & marketing through our channels (website, social media, newsletters, features).
Member introductions to new people who may not otherwise find your community.
Booking system support: confirmations, reminders, and (where applicable) online links for virtual gatherings.
Payment handling via Stripe Connect, ensuring secure and reliable payouts.
Administrative support for cancellations and refunds in line with the platform policy.
Community connection: opportunities to join co-creation circles, collaborations, and workshops.
Professional credibility by being part of a vetted, values-led platform centred on kindness, accessibility, and integrity.

3. Your Responsibilities

By joining, you agree to:

Accurate listings: keep your description, schedule, prices, and access details up to date.
Standards: provide gatherings that are safe, inclusive, and respectful.
Insurance: hold appropriate insurance if your activity requires it (e.g., yoga, movement, therapy).
Legal compliance: follow all applicable laws, including safeguarding, health & safety, and data protection.
Kind🌿Root values: act with kindness, inclusivity, and integrity in all sessions connected to the platform.
Independent status: you are not an employee, worker, or agent of The Kind🌿Root Space. You remain fully responsible for your own operations and taxes.

4. Payment & Fees

All member bookings and payments are processed securely via Stripe Connect.
The Kind🌿Root Space retains a 15% platform commission on each completed booking to cover marketing, administration, and platform costs.
The remaining balance (minus Stripe fees) is paid directly to you via your Stripe Express account.
You set your own membership fees, ticket prices, or contributions (within the ranges indicated in your onboarding form).
You are responsible for declaring and paying your own taxes.

5. Bookings

All member bookings must be arranged and confirmed through The Kind🌿Root Space. This ensures bookings are tracked, protected by our cancellation/refund policy, and paid securely via Stripe Connect.
If you are set up with an Acuity calendar, members will book through your assigned calendar.
If you use your own scheduling link (e.g., Calendly, Zcal), you must provide this link to us for coordination. Members may only receive your link via The Kind🌿Root Space. You must always CC or forward all booking confirmations to 📧 bookings@thekindrootspace.com so we can track bookings and process payments through Stripe Connect.
After each gathering, members may be sent a short feedback form by The Kind🌿Root Space. This ensures reflections are collected centrally and supports the growth and quality of your community.
You agree not to solicit, accept, or process bookings with any member introduced via The Kind🌿Root Space outside of the platform or without payment via Stripe Connect for a period of 6 months after the member’s first booking.

6. Cancellations & Refunds

Members may cancel a booking up to 48 hours before the scheduled start time to receive a full refund.
Cancellations made between 24 and 48 hours before the session will be eligible for a 50% refund of the fee.
Cancellations made less than 24 hours before, or failure to attend a booked session without notice (“no-show”), are non-refundable.
Refunds are processed securely through Stripe and facilitated by The Kind🌿Root Space.
Communities may choose, at their own discretion, to offer more flexible solutions (such as rescheduling or granting a full refund), provided these are in the spirit of fairness and kindness.
How cancellations work:
Members must cancel through the booking system, which will automatically process refunds in line with this policy.
Communities who need to cancel a gathering must notify The Kind🌿Root Space immediately so we can support members in rescheduling or issuing a full refund.
All communities on the platform agree to follow this minimum standard cancellation policy for bookings made via The Kind🌿Root Space.

7. Confidentiality & Data Protection

You must handle all member information with strict confidentiality.
You must comply with GDPR and other applicable data protection laws.
The Kind🌿Root Space may share member contact details with you only for the purpose of delivering your gathering.
By joining, you consent to us securely storing and processing your data for platform operations.

8. Safeguarding & Duty of Care

If a member discloses information that raises safeguarding concerns, you must follow legal and professional guidelines.
The Kind🌿Root Space should be informed if a safeguarding issue arises in connection with a booking made through the platform.

9. Mediation & Disputes

If a member raises an issue regarding a booking made through The Kind🌿Root Space, we may act as a neutral mediator to support resolution.
Our role is to facilitate communication between you and the member, but we are not legally responsible for the outcome of your gatherings.
In the event of a refund request or complaint, we will:
Review the circumstances with both parties.
Apply the standard cancellation/refund policy.
Process any refund due via Stripe Connect.
If a complaint relates to serious misconduct, safeguarding, or safety, we reserve the right to suspend or remove your profile immediately while we review.
Any unresolved disputes between you and a member remain your responsibility as an independent community.

10. Communications

By joining The Kind🌿Root Space, you agree that we may send you essential service-related emails, including updates about bookings, payments, cancellations, and platform policies. These are required as part of your participation on the platform.
You may also choose to receive optional community and marketing emails (such as features, event invitations, or collaboration opportunities). You can opt in or out of these at any time.
We will not share your email address with third parties for marketing purposes.

11. Liability

You are fully responsible for the gatherings you provide, including member safety, wellbeing, and outcomes.
The Kind🌿Root Space is a connection platform only; we do not supervise or guarantee your gatherings.
You agree to indemnify The Kind🌿Root Space against any claims, costs, or damages arising from your community’s activities.

12. Ending the Agreement

Either party may terminate this agreement with 30 days’ written notice.
We may suspend or remove your profile immediately if you:
Breach these terms.
Provide unsafe gatherings.
Act in a way that damages member trust or The Kind🌿Root Space community.

13. Changes to These Terms

We may update these Terms from time to time.
You will be notified of significant changes. Continued use of the platform indicates acceptance of updated Terms.

14. Governing Law

This Agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
